Malong Wines Ltd — Terms & Conditions

Welcome to Malong Wines Ltd (“Malong Wines”, “we”, “us”, “our”). These Terms & Conditions govern your use of www.malongwines.com (the “Site”) and any purchases, services or interactions made through the Site or with our staff. By visiting, browsing, registering an account or placing an order you accept and agree to be bound by these Terms. If you do not agree, please do not use the Site or place orders.

1. Who we are

2. Eligibility & Age restriction

You confirm that you are at least 18 years old and legally permitted to purchase alcohol in Kenya. We operate an age-gate on entry to the Site and may request photographic ID upon delivery. Orders may be refused if the recipient cannot prove legal age.

3. The Service

We sell premium Australian wines and related products. The Site provides product information, ordering, payment and delivery management. All features and content may be modified, expanded or removed at our discretion.

4. Account & Accurate Information

If you create an account you agree to keep account details accurate and secure. You are responsible for all activity on your account. Notify us immediately of any unauthorised use.

5. Ordering & Acceptance

Placing an order does not guarantee acceptance. Once you submit an order you will receive an order confirmation email. We may accept, reject, or cancel orders for any reason (including out-of-stock items, pricing errors, suspected fraud, or restrictions). If we cancel after payment we will refund in full.

6. Prices, Taxes & Currency

Prices shown are in Kenyan Shillings (KES) unless specified. Prices may change without notice. Where applicable, taxes, duties or import fees are displayed at checkout or charged on delivery; international customers are responsible for customs and local duties.

7. Payment Methods

We accept payments via the methods presented at checkout, which may include:

  • M-Pesa (Lipa na M-Pesa) — follow on-screen instructions at checkout.

  • Credit/Debit cards (Visa, Mastercard, AMEX) via a PCI-compliant payment gateway. We do not store full card details on our servers.

  • Bank transfer (details provided during checkout or on invoice).

  • Cash on Delivery (COD) — available only for selected Nairobi deliveries and subject to limits; delivery staff may not carry change, so exact cash is required.

We reserve the right to validate and verify payment information before dispatch.

8. Shipping & Delivery

  • We deliver within Nairobi and offer scheduled nationwide shipping by arrangement. Delivery windows, fees and lead times are quoted at checkout or on confirmation.

  • For same-day delivery in Nairobi we may require orders to be placed before a specified cut-off time (e.g., 4:00 PM on business days). Cut-off times are indicative and subject to availability.

  • Delivery fees vary by location, order weight and service level. Large or corporate orders may attract bespoke delivery charges.

  • A valid phone number and delivery address must be supplied. If you are not available to receive your delivery, we may leave the goods only if explicitly authorised or attempt re-delivery (additional charges may apply).

  • For alcohol deliveries, the driver will request valid government ID to verify age. Orders may be refused if ID is not presented.

9. Pre-orders, Allocations & Backorders

Some limited-release or pre-arrival products may be offered for pre-order. Estimated arrival dates will be provided; these are estimates and may change. Payment terms for pre-orders will be specified at the time of purchase.

10. Returns, Refunds & Damaged Goods

  • Inspect your order on arrival. Report damaged, missing, or incorrect items within 48 hours of delivery by emailing contact@malongwines.com with photos and your order number.

  • We will assess reported issues and, where appropriate, replace items or issue refunds to the original payment method.

  • We do not accept returns of opened bottles for hygiene and safety reasons. Unopened products returned for change of mind may be accepted at our discretion within 7 days, subject to inspection and potential restocking fees; return shipping costs are usually borne by the customer unless otherwise agreed.

  • Special order items, allocations or personalised goods may be non-returnable; such restrictions will be stated at purchase.

11. Cancellations & Changes

If you need to cancel or modify an order, contact us immediately at +254 724 015277 or contact@malongwines.com. We will endeavour to accommodate changes prior to dispatch but cannot guarantee cancellation once an order has been processed or shipped.

12. Availability & Product Information

We make efforts to accurately describe products (vintage, ABV, tasting notes, awards). However, colours and display may vary by monitor and we may need to substitute products of similar quality if a particular item is unavailable—your consent will be sought for major substitutions.

13. Promotions & Discounts

Promotional offers are subject to terms and may be limited by time, stock, or eligibility. Offers cannot typically be combined unless expressly stated.

14. Intellectual Property

All Site content (text, images, logos, designs) is owned or licensed by Malong Wines. You may not reproduce, distribute, or use our content without prior written permission.

15. User Content

If you submit reviews, photos or comments you grant Malong Wines a worldwide, royalty-free licence to use, publish and adapt that content. You warrant that your submissions do not infringe third-party rights.

16. Third-Party Links & Services

The Site may link to third-party services (payment gateways, delivery partners, suppliers). We are not responsible for third-party content, policies, or actions. Review each third-party’s terms before engaging.

17. Liability & Disclaimers

To the maximum extent permitted by law, Malong Wines and affiliates are not liable for indirect, incidental, special or consequential damages, loss of profit or data arising from use of the Site or products. Our liability for direct loss is limited to the amount paid for the product or the transaction in question.

18. Indemnity

You agree to indemnify and hold Malong Wines, its officers, employees and partners harmless from claims, damages or costs arising from your breach of these Terms or misuse of the Site.

19. Termination

We may suspend or terminate access to the Site or services without notice for breach or suspected unlawful activity. Termination does not waive rights to outstanding amounts or remedies.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya. Parties will seek amicable resolution first; disputes unresolved may be brought before Kenyan courts.

21. Changes to Terms

We may update these Terms from time to time. The current version is published on the Site. Continued use after changes indicates acceptance.
